During that meeting, the homeowners decisively voted to remove these individuals from the board. Yet, they have refused to step down, disregarding your votes and the democratic process.

Clarifying a Misconception
Before diving into the posts, I’d like to clarify two important points:
1. Jim Meyers and Prism Realty’s Role
Jim Meyers, the owner of Prism Realty, is not a member of the Sunset Park Condominiums HOA Board. He does not own the land on which your condo is situated, nor does he have any authority over how we use our HOA fees or make decisions for our community. Prism Realty is simply the management company hired to assist with the day-to-day operations of our association. In this capacity, Jim Meyers, owner of Prism Realty, is an employee providing services on behalf of Sunset Park Condominiums.
Your HOA fees are not deposited into Jim Meyers’ or Prism Realty’s bank account. If they are being deposited into his account, then this is illegal. Instead, these funds are directed into the official bank account of the Sunset Park Condominiums Association. The HOA Board is responsible for managing these funds to pay for services provided by contractors like Prism Realty, as well as covering essential expenses such as water, sewer, and lawn maintenance.
In essence, we, the homeowners and board members, are the employers of Prism Realty and other contractors. Our HOA fees fund their services, but ultimate decision-making authority resides solely with the HOA Board.
During the annual meeting on December 2, 2024, Michael Kane disclosed that our board does not currently have a treasurer—the individual responsible for overseeing our association’s funds. Instead, he stated that Jim Meyers, the owner of Prism Realty, is acting as our financial overseer. This arrangement represents a clear conflict of interest.
As outlined in standard HOA practices, the treasurer plays a critical role in managing financial records, ensuring transparency, and safeguarding the association’s funds. Delegating this responsibility to an external party like Jim Meyers compromises the integrity of our financial oversight and raises ethical concerns. It is essential that this role be filled by an elected board member to maintain accountability and protect the interests of all homeowners.
Clarification of HOA and roles on BoARD
The Sunset Park Condominiums (SPC) Homeowners Association (HOA) is composed of all homeowners within the community and is governed by a Board of fiduciaries. Fiduciaries are individuals entrusted to act on behalf of the homeowners, prioritizing their interests above all else while maintaining good faith and trust. These fiduciaries are legally and ethically obligated to make decisions that benefit the community as a whole.
Prior to August 28, 2023, the SPC HOA Board consisted of only three members—Stephanie P., Karen H., and Michael K.—occupying three positions, despite the bylaws requiring a minimum of five positions. It’s important to note that Jim Meyers, the owner of Prism Realty, is not a board member and has no authority over how HOA fees are managed or how decisions are made for the community. Prism Realty serves solely as the management company hired to assist with operations.
Although the SPC HOA operates as a non-profit organization with volunteer board members, it is still required to adhere to corporate laws. This means the HOA Board has a fiduciary duty to act in the best interests of both the association and its members. No individual serving on the board may receive financial or personal benefits from their role.
What Does This Mean for Homeowners?
The fiduciary responsibilities of the HOA Board include:
